21 U.S.C. § 321 — drug definition

If brand copy implies a substance is intended for diagnosis, cure, mitigation, treatment, or prevention of disease, FDA can classify it as an unapproved drug. Brand-side copy stays sterile. RUO framing, in-vitro context, no disease/cure/treat language. The 2024-2025 warning letter wave hit this exact line.

Even compliant supplements cannot make disease claims. Structure/function claims must be substantiated and disclaimed. For peptides, the safer path is to avoid structure/function claims on brand-side copy and let affiliates carry storytelling under MSA.

Endorsers must disclose material connections clearly and conspicuously. #ad, #sponsored, paid partnership tags are not optional. Brands are responsible for monitoring endorsers. PELORA's MSA template includes mandatory FTC disclosure clauses and content review workflow.

Any objective claim made in advertising must be supported by competent and reliable scientific evidence at the time the claim is made. Affiliate claim libraries are scoped to what is actually substantiated, not what reads well.

Controlled Substances Act

Most research peptides are not scheduled. Specific compounds (e.g. some growth-hormone secretagogues, certain prohormone peptides) sit closer to the line. We do not market controlled substances. We are explicit on the strategy call about compounds we will and will not handle.

State law

California Prop 65, NY AG, FL DBPR

State enforcement varies. California Prop 65 affects ingredient warnings; New York AG has gone after supplement claims; Florida regulates compounding pharmacy interfaces. Brand legal counsel runs the state-by-state review. We ship copy that fits inside the strictest state's rules by default.

RUO (Research Use Only) is a compliance posture, not a marketing license. Legal in the US when brand-side copy stays disciplined: research-only language, in-vitro context, COA presentation, age-gating, no disease/structure-function claims. Affiliate and influencer claims that are properly contracted under MSA with claim restrictions and indemnification can carry the human-use storytelling. PELORA Marketing is not a law firm.

Will Meta or Google ever stop banning peptide ads?
